Nonprofit Terms & Conditions

To participate in Coastside Gives, I, as the designated representative of my organization, agree to the following terms and conditions: 

  • I confirm that my organization provides services that directly impact the Coastside area from Pescadero to Montara, California, and that funds raised through Coastside Gives will be used for services and programs directly impacting this area.  

  • I confirmed that my organization is a 501(c)(3) tax-exempt nonprofit organization in good standing with the Internal Revenue Service (IRS), California Franchise Tax Board, and California Department of Justice, eligible to receive tax-deductible donations. 

  • I understand that if my organization falls out of good standing with the IRS, California Franchise Tax Board or California Department of Justice, all donations will be suspended until my organization has returned to a good standing status with all three agencies. See the Nonprofit Compliance page for information on how to check and update your status. 

  • I confirmed that my organization is compliant with all applicable federal, state, and local laws, ordinances and regulations including, but not limited to, the USA Patriot Act and all applicable anti-terrorist financing and asset control laws.

  • I confirmed that my organization has two years of financial reporting using either an IRS FORM 990 or 990EZ ONLY. Forms 990-Ns, 990-PFs, or any other financial report or document, are not acceptable. Some exceptions apply, such as if your organization is a fiscally-sponsored organization. If so, your fiscal sponsor must adhere to these financial reporting, along with the federal and state government compliance requirements stated above. You must also provide a copy of your fiscal sponsorship agreement.

  • I confirmed that my organization is the only organization applying to participate under this specific 501(c)(3) tax ID number. 

  • I confirmed that my organization is governed by a body such as a board of directors, board of trustees, or similar. 

  • I understand that as the Coastside Gives representative for my organization, I will serve as the main contact for the organizers of Coastside Gives. I also understand that as my organization’s Coastside Gives representative I will communicate with my organization’s staff, board, and volunteers to keep them informed about Coastside Gives updates, deadlines, and requirements. I also understand that I am responsible for updating the point of contact information should the organization representative or contact information change.

  • I understand that all questions regarding Coastside Gives should come from the organization’s representative and sent via email to coordinator@maverickscommunityfoundation.org.

  • I confirm that I have read and understood all the requirements of participation listed on the Coastsidegives.org website, including the Nonprofit Eligibility and Nonprofit Compliance pages. 

  • I understand that my organization must complete all requirements, including creating or updating my organization’s profile page, by the deadlines posted in order to participate. I also understand that failure to meet any of the requirements may cause my organization to be ineligible for participation in Coastside Gives.

  • I understand that by participating, I agree to be respectful of sponsors, fellow participants, donors, and event organizers. Any action that is deemed otherwise by Mavericks Community Foundation may jeopardize my organization's participation in the current or future Coastside Gives.

  • I understand that Mavericks Community Foundation reserves the right to approve or deny my organization’s participation based on its own discretion and, if approved, that the registration and Giving Guide fees are non-refundable.


Coastside Gives Donations & Prize Grants

I understand that:

  • Coastside Gives is an online fundraising program. In order for donations to be counted for the incentive prizes, donations MUST be made online through the CoastsideGives.org website and designated to participating organizations. Donations of cash and checks must be manually entered on the platform as an offline donations.

  • Each donation processed through the Coastside Gives is 100% tax deductible.

  • My organization will not solicit donations in conjunction with Coastside Gives by providing any benefit or privilege to a donor in return for their donation made, including for goods, services, raffles, auctions, memberships, legally binding pledges, support of political campaigns, or other “quid pro quo” items that provide benefit to the donor.

  • Donations will be disbursed directly from the Mightycause Charitable Foundation through this Mightcause platform, twice a month if via EFT or once a month if via check, based on your organization's preferences as designated in the organization platform profile. There is a $5 fee for check disbursements to cover costs.

  • Any prize grant awards earned will be distributed by Mavericks Community Foundation within 30 days of close of the event to any qualifying organization

  • My organization will have access to its donor list, which includes contact and amount information for their specific donors. Donor information is never sold to a third party. Confidential donor information will never be shared with the organization at the donor’s specific request.


Platform Fees

I understand that:

  • Mightycause is the technology partner platform for Coastside Gives and all transactions are secure as data is encrypted. 

  • During Coastside Gives, each donor transaction will incur third-party charges. Donations will be charged 6.5% in processing and credit card fees. At the point of transaction, donors will be provided the option of boosting their gift to help cover these third-party fees. Otherwise, fees will be deducted from the individual donations.


Promotion and Marketing

I understand that:

  • My organization should promote the event to our donors through methods of our choosing and may take advantage of the Coastside Gives promotional and marketing materials that are made available. Any paid promotional methods utilized by my organization are solely at my organization’s discretion and expense.

  • Event organizers will promote the Coastside Gives through media partners and may provide social media marketing materials and training to my organization accordingly.

  • My organization is responsible for cultivating donors through the Coastside Gives.


Liability Release

As the appointed representative, I hereby release the Mavericks Community Foundation, Coastside Gives, and its affiliates, officers, board, and employees, jointly and severally, from any claims for any loss or damage sustained while participating in the Coastside Gives. This release extends, applies to, and also covers and includes all unknown, unforeseen, unanticipated and unsuspected injuries, damages, losses and liability and the consequences thereof, as well as those now disclosed and known to exist. This release also extends to coordination of participation efforts and use of public content from this organization’s websites for marketing purposes. It is further understood and agreed that participation in the Coastside Gives is not to be construed as an admission of any liability and/or acceptance of assumption of responsibility by the Mavericks Community Foundation and its affiliates, officers, board, and employees, jointly and severally, or for any damages and expenses for which the Mavericks Community Foundation, and its affiliates, officers, board, and employees become liable as a result of any alleged act of a Coastside Gives participant.
